General Terms and Conditions of Sale for Digital Content
Article 1: Purpose of the contract
These general terms and conditions of sale apply exclusively to sales of digital content (hereinafter referred to as "Digital Content") made to consumers by download via the Gathope.com website (hereinafter referred to as the "Platform").
Digital Content" refers to :
- the Gathope magazine in its PDF format, including text, images, graphics, visual and graphic elements and all similar elements
- Gathope magazine in its directly accessible online web format, including text, images, graphics, visual and graphic elements and all other such elements.
Download" means the transmission and reproduction of a file, including the Digital Content you choose, on an electronic device connected to the Internet.
Article 2: Order process and validation
To order, you must have the legal capacity to contract.
Once your online order has been validated, it cannot be cancelled once payment has been accepted.
Validation of the order implies unreserved acceptance of these terms and conditions of sale.
We will confirm your order by e-mail and send you the link to download the selected Digital Content.
Once your order has been validated, you can request an invoice, which will be sent to the postal and digital address you provided when placing your order.
Purchases of Digital Content are considered firm and final, and may not be exchanged or reimbursed. Please note that the fourteen-day cooling-off period provided for in Article L.221-18 of the French Consumer Code does not apply to this service once we have accepted and executed your order by sending you the download link.
Article 3 : Technical conditions of access to the service
In the event of difficulties, and in particular if you do not receive the download or online reading links at the e-mail address associated with your customer account, you can contact POLL's customer service department at the following e-mail address: infos@pollinternational.com.
If the problem persists and the download link cannot be activated, you may request a refund of your order within thirty days of payment. The amount of the payment will be reimbursed by crediting your bank account or by cheque sent in your name and to the billing address given at the time of ordering.
Article 4 : Prices of Digital Content
The prices of the Digital Content are indicated in Swiss francs, euros or dollars and are exclusive of tax. The cost of communication to access the site remains at your charge.
The prices of Digital Content may be modified without notice, it being specified that they will be invoiced on the basis of the rates in force at the time of order confirmation.
Article 5 : Payment methods
Digital Content ordered on the gathope.com platform is paid for
- either via Direct Carrier Billing (DCB), i.e. direct billing by a telephone operator
- or by valid credit or debit card (Carte Bleue, Visa, Eurocard or Mastercard).
Payments must be made with international credit cards.
Article 6 : Transaction security
The Gathope.com platform is secured by an SSL (Secure Sockets Layer) certificate, which encrypts information relating to your bank details.
Article 7 : Copyright protection
The Digital Content and all elements reproduced on the Gathope.com platform (notably texts, comments, illustrations, logos and iconographic documents) are protected by the French Intellectual Property Code and by applicable international standards.
As such, Digital Content is intended for strictly personal and private use only.
Any reproduction, adaptation or representation in any form and by any means whatsoever, and in particular any exchange, resale, rental or transfer to a third party of the Digital Contents is strictly forbidden and will be considered as an infringement of copyright liable to criminal prosecution.
You expressly agree to keep the download link transmitted to you confidential and not to communicate it in any form whatsoever to a third party.
Article 8 : Liability
We cannot be held responsible for service interruptions due to the characteristics and limitations of the Internet network, particularly in the event of interruptions to access networks, technical performance and response times for consulting, querying or transferring information contained on the Gathope.com platform or in Digital Content.
Given the intrinsic characteristics of the Internet, we cannot guarantee against the risks of misappropriation, intrusion, contamination and piracy of data, programs and files by computer viruses. It is your responsibility to take all appropriate measures to protect your own data, programs and files. We cannot be held responsible for any damage caused by computer viruses.
Article 9: Protection of personal data
Information and data concerning you are necessary for the management of your order. You may receive offers from our company and our group if you accept them when you place your order.
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify or oppose any data concerning you by contacting POLL's customer service department at infos@pollinternational.com.
Article 10: Changes to the general terms and conditions of sale
We reserve the right to modify all or part of these terms and conditions of sale at any time. Any such modifications will be enforceable from the date they are posted online and cannot be applied to contracts concluded previously.
We reserve the right to temporarily or permanently close the Gathope.com platform, without notice or compensation.
Article 11 : Applicable law and settlement of disputes
These general terms and conditions of sale are governed by Swiss law. All disputes shall fall within the exclusive jurisdiction of the courts of Geneva.
